TERMS OF REFERENCES FOR THE PRODUCTION OF A VIDEO CLIP

COERR Foundation

1. Introduction:

COERR Foundation is a non-profit organization registered with the Ministry of Interior on 3 November 2017. It was formerly known as the Catholic Office for Emergency Relief and Refugees (COERR), operating under the Catholic Bishops’ Conference of Thailand since 20 December 1978. The organization has implemented various projects in nine temporary shelters located along the Thai–Myanmar border in Kanchanaburi, Ratchaburi, Tak, and Mae Hong Son provinces. These operations have been carried out since 1984 and continue to the present day. 

2. Project Framework

The “Chiwit Dee Dee” Project is a 39-month project that began in October 2023. Its objective is to strengthen the capacity of displaced persons to produce fresh food products in the temporary shelters by using low external input organic agriculture technologies to safeguard their food security and, in the process, develop their knowledge and skills in the practice of Organic Agriculture as an effective, sustainable, and empowering livelihood strategy that will lead to greater self-reliance and resiliency. The project is implemented in nine temporary shelters and in 14 Thai schools located near the temporary shelter areas. 

3. Profile of the consultant team  

1. The bidder must be an individual or a legal entity with experience in similar types of work, having been a direct contractual partner with a government agency or a private organization trusted by the COERR Foundation. Evidence of such work must be submitted together with the bidding documents.
2. The bidder must be a direct contracting party and must not have any shared interests with other bidders in this procurement process, nor engage in any actions that obstruct fair competition.
3. The bidder must have good knowledge of the situation of refugees from Myanmar in Thailand, including security-related issues concerning the dissemination of media related to refugees, and must respect cultural and religious diversity.
4. Teams with members who can speak Karen or Burmese will receive special consideration. 

4. Duties and deliverable products

The deliverable for this consultancy will be the following

1. Produce a video media production using a professional-grade video production equipment with clear image and sound resolution. The video must include subtitles in four languages: Thai, English, Karen, and Burmese. 
2. This video media focuses on the development of knowledge and skills in organic agriculture, as well as the promotion and development of small-scale businesses in four temporary shelter areas: Umpiem (Phop Phra District) and Mae La (Mae Ramat District) in Tak Province; and Mae La Oon and Mae Lama Luang (Sop Moei District) in Mae Hong Son Province. A total of seven case examples will be presented as follows:
   • Showcase the personal story of 3 refugee farmers who has received training in skills and knowledge in organic farming and show their learning processes and their life improvement; 
   • Showcase the personal story of 2 refugees who have received livelihood support grants.
   • Showcase the personal story of 2 farmer groups; young farmer and animal bank who have been supported to implement agriculture and small animal projects
3. Prepare a concept outline, storyboard, and script in consultation with the committee assigned by the COERR Foundation, including discussions on content, duration, and other details. The proposal must be presented to the committee for review and revision before actual production begins.
4. All visuals used must be real footage filmed on location within the temporary shelters only. The video must include titles and graphics that are visually appealing, modern, and easy to understand, consistent with the content. The production must include engaging visuals, professional editing of original video sequences, and appropriate graphic text design.
5. Background music and narration must be produced to ensure they are appropriate, harmonious, and aligned with the visuals and audio of the video production. All materials must not infringe any copyrights. In the event of any complaints or legal claims, the contractor will be fully responsible.
6. The contractor must submit draft versions to the committee for review and make revisions as required until the video is finalized and approved by the committee for acceptance.

5. Timeframe 

The consultancy covers a span of 90 days from the signature of the contract. There will be flexibility in theimplementation of the required tasks and submission of products, according to the needs identified during the process of consultancy.

6.Budget and method of payment

The maximum available Budget for the consultancy is 350,000 baht (VAT and travel cost are included). The payment procedure will follow COERR Foundation internal procedures.

7. Contract Agreement

The successful bidder must enter into a contract with the COERR Foundation within 7 days from the date of notification.  The relevant contract will be signed by the COERR Foundation. The contract will specify the implementation period, costs, and related conditions, and this TOR document will be attached as an integral part of the contract.

8. Follow up and supervision

The follow up of the work will be performed by COERR Foundation designated coordination team for this project. The consultant must ensure a close communication with the contracting entity, so that all drafts products can be followed and validated before going into the next production phase.

9. Ethical and professional behavior premises

The following basic premises are required for ethical, professional behavior by the work team:

• Anonymity and confidentiality: The team must uphold people’s right to provide information anonymously and in confidence.
• Ethics: The team must ensure through a signed commitment to strictly comply with COERR Foundation Code of Conduct while performing the service.
• Independence: The team must assure its independence from the intervention undertaken, having no links with its management or any of its component parts.
• Data protection: The Consulting firm undertakes to maintain the strictest professional secrecy and confidentiality in respect of any personal data to which it has access in consequence of the work carried out and to duly comply with the duty of custody of such data required under the Personal Data Protection Act B.E. 2562 / 2019.    This requirement shall apply to the consultancy firm throughout the term of the services contract and subsequent to its expiry for any related cause.  The consultancy firm further expressly undertakes to take the necessary technical and organisational steps to protect the security of any personal data to which it has access and to prevent any alteration, loss, unauthorised processing of or access to such data, taking into account the current technology available, the nature of the data stored and the risks to which it is exposed, whether from human action or from the physical or natural environment, complying in this respect with the relevant provisions of the Personal Data Protection Act B.E. 2562 / 2019 at all times.
• Incidents: Any problems arising during the field work or at any other stage must be communicated immediately to COERR Foundation, which at its own discretion will forward the relevant information to the funding agency. Otherwise, the existence of any such problems may not be used to justify any failure to obtain the results established by COERR Foundation under this TOR.
• Copyright and dissemination. It should be clear that the consultant must give up the rights of use and dissemination to the contracting entities. By virtue of the grant contract between the contracting entities and the European Union, the latest is also entitled to make use and dissemination of any and all audio-visual materials produced by the project.
• Penalty arrangements. In the event of any delay in the delivery of reports or if the quality of the reports delivered is manifestly lower than what was agreed with COERR Foundation, the penalties and arbitration measures established by the contracting entity under the official terms and conditions of the contract entered into with the consultancy firm shall apply.

10. Requirements for the presentation of proposals

The submitted proposals must include at least the following information. 

1. Technical proposal;
2. Detailed economic offer expressed in Thai Baht. It must be inclusive of VAT and/or any other relevant taxes.
3. CV of the consultant/consultant team.

11. Selection and evaluation criteria

Selection criteria will be both technical and financial, considering the proposal that best fits the needs of the organizations and the activity proposed.

The bids submitted will be scored with a possible total of 100 points, broken down as follows:

1. Technical quality of the proposal and its suitability for the purposes fixed: 40 points.
2. Composition of the team: 40 points
3. Financial proposal: 20 points

Bidders will be informed of their exclusion or success within 15 calendar days of the opening of the proposals received.

12. Submission of proposals

Technical and financial proposals shall be submitted before May 4, 2026 at the latest.

ขอบเขตงาน การจ้างผลิตสื่อวีดีทัศน์ของมูลนิธิโคเออร์ 

1.ความเป็นมา  

มูลนิธิโคเออร์ เป็นหน่วยงานไม่แสวงหาผลกำไร จดทะเบียนจัดตั้งมูลนิธิกับกระทรวงมหาดไทย เมื่อวันที่ 3 พฤศจิกายน 2560 เดิมมีชื่อว่า  สำนักงานคาทอลิกสงเคราะห์ผู้ประสบภัยและผู้ลี้ภัย (โคเออร์) ดำเนินงาน ภายใต้สภาแห่งประมุขบาทหลวงโรมันคาทอลิกแห่งประเทศไทย ตั้งแต่วันที่ 20 ธันวาคม พ.ศ. 2521 โดยมีการดำเนินงานโครงการต่าง ๆ ในพื้นที่พักพิงชัวคราวฯ จำนวน 9 แห่ง ที่ตั้งอยู่ตามแนวชายแดนไทย-เมียนมา ด้าน จ.กาญจนบุรี จ.ราชบุรี จ.ตาก และ จ.แม่ฮ่องสอน  ตั้งแต่ปี พ.ศ.2527 เป็นต้นมาจนถึงปัจจุบัน

2. กรอบของโครงการ  

โครงการ “ชีวิตดีดี” เป็นโครงการที่มีระยะเวลาดำเนินการ 39 เดือน เริ่มตั้งแต่เดือนตุลาคม 2566 เป็นต้นมา โดยมีเป้าหมายเพื่อเสริมสร้างศักยภาพของผู้หนีภัยฯ ในการผลิตอาหารสดภายในพื้นที่พักพิงชั่วคราวฯ  โดยใช้เทคโนโลยีเกษตรอินทรีย์ที่ลดการพึ่งพาปัจจัยการผลิตจากภายนอก  เพื่อเสริมสร้างความมั่นคงทางอาหารพร้อมทั้งพัฒนาองคค์วามรู้และทักษะในการทำเกษตรอินทรียใ์ห้เป็นแนวทางการดำรงชีพที่ มีประสิทธิภาพ ยั่งยืนและเสริมพลังให้กับชุมชน ซึ่งจะนำไปสู่การพึ่งพาตนเองและความสามารถในการรับมือกับความเปลี่ยนแปลงได้มากขึ้น  โครงการนี้ดำเนินงานในพื้นที่พักพิงชั่วคราวฯ จำนวน 9 แห่ง และในโรงเรียนไทย ซึ่งตั้งอยู่ใกล้พื้นที่พักพิงชั่วคราวฯ จำนวน  14 โรงเรียน        

3. คุณสมบัติของผู้เสนอราคา         

1. เป็นบุคคลธรรมดา หรือนิติบุคคล ที่มีผลงานประเภทเดียวกัน และเป็นผลงานที่เป็นคู่สัญญาโดยตรงกับหน่วยงานของรัฐ หรือหน่วยงานเอกชนที่มูลนิธิโคเออร์เชื่อถือ และให้ระบุผลงานดังกล่าวส่งมา พร้อมกับเอกสารการประมูลด้วย

2. ผู้เสนอราคาต้องเป็นคู่สัญญาโดยตรง และไม่เป็นผู้มีผลประโยชน์ร่วมกันกับผู้ยื่นข้อเสนอรายอื่นในการประมูลครั้งนี้ หรือไม่เป็นผู้กระท าการอันเป็นการขัดขวางการแข่งขันอย่างเป็นธรรม

3. ความรู้เป็นอย่างดีเกี่ยวกับสถานการณ์ของ ผู้ลี้ภัยจากเมียนมาในประเทศไทย และประเด็นด้านความมั่นคงที่เกี่ยวข้องกับ การเผยแพร่สื่อที่เกี่ยวข้องกับผู้ลี้ภัย รวมทั้งให้ความเคารพต่อ ความหลากหลายทางวัฒนธรรมและศาสนา

4. หากมีสมาชิกในทีมที่สามารถพูด ภาษากะเหรี่ยงหรือภาษาพม่า ได้จะได้รับการพิจารณาเป็นพิเศษ

4. รายละเอียดของงาน   

1. ผลิตสื่อวีดีทัศน์ ด้วยกล้องระบบคุณภาพสูง ที่มีความละเอียดของภาพและเสียงคมชัด มีคำบรรยาย 4 ภาษา คือ ไทย อังกฤษ กะเหรี่ยง และพม่า

2.  สื่อวีดีทัศน์นี้เกี่ยวกับ งานพัฒนาองค์ความรู้และทักษะในการทำเกษตรอินทรีย์ รวมทั้งด้านการส่งเสริมและพัฒนาอาชีพธุรกิจขนาดย่อม ในพื้นที่พักพิงชั่วคราวฯ จำนวน 4 แห่ง คือ บ้านอุ้มเปี้ยม อ.พบพระ และบ้านแม่หละ อ.แม่ระมาด จ.ตาก บ้านแม่ละอูน และ บ้านแม่ลามาหลวง อ.สบเมย จ.แม่ฮ่องสอน รวมทั้งสิ้น จ านวน 7 ตัวอย่าง ดังนี้

• ผู้หนีภัยฯ ที่ได้รับการพัฒนาด้านทักษะ ความรู้ ด้านเกษตรอินทรีย์ จำนวน 3 คน
• ผู้หนีภัยฯ ที่ได้รับการทุนสนับสนุนด้านอาชีพ จำนวน 2 คน
• กลุ่มเยาวชน และกลุ่มเกษตรกร ที่ได้รับการสนับสนุนด้านเกษตรกรรมและการเลี้ยงสัตว์ จำนวน 2 กลุ่ม

3. จัดทำเค้าโครงเรื่องหรือ Story Board และบท โดยหารือร่วมกับคณะกรรมการที่ได้รับมอบหมายจากมูลนิธิโคเออร์ ทั้งเนื้อหา ความยาว และรายละเอียดอื่น ๆ รวมทั้งนำเสนองานเพื่อให้คณะกรรมการพิจารณาปรับแก้ได้ก่อนการผลิตจริง

4.  ภาพที่ใช้ประกอบต้องเป็นภาพที่มาจากสถานที่จริงภายในพื้นที่พักพิงชั่วคราวฯ และถ่ายทำจริงเท่านั้น วีดีทัศน์นี้ต้องมีการจัดทำไตเติ้ลและกราฟฟิกที่มีความสวยงาม ทันสมัย เข้าใจง่าย สอดรับกับเนื้อหา มีภาพประกอบที่ทันสมัยและน่าสนใจ ตัดต่อลำดับภาพวิดีโอต้นฉบับ และจัดทำกราฟิกตัวอักษรให้มีความเหมาะสม

5.  การจัดทำเสียงดนตรีประกอบพร้อมเสียงบรรยาย ให้มีความเหมาะสมกลมกลืนและสอดรับกับภาพและเสียงที่ประกอบในการจัดทำวีดีทัศน์ และจะต้องไม่ละเมิดลิขสิทธิ์ ใด ๆ ทั้งสิ้น หากมีการร้องเรียนหรือฟ้องร้อง ผู้รับจ้างจะต้องเป็นผู้รับผิดชอบทั้งหมด

6. ผู้รับจ้างจะต้องส่งต้นฉบับให้คณะกรรมการพิจารณา และต้องปรับแก้ไขจนกว่าวีดีทัศน์เป็นฉบับสมบูรณ์เพื่อให้คณะกรรมการตรวจรับงาน

5. ระยะเวลาดำเนินการและส่งมอบงาน

ผู้รับจ้าง ต้องส่งมอบงานที่ถ่ายทำเสร็จแล้ว ภายในระยะเวลา 90 วัน นับถัดจากวันที่ลงนามในสัญญาจ้าง

6.  งบประมาณและเงื่อนไขการชำระเงิน

งบประมาณสูงสุดคือ 350,000 บาท (รวมภาษีมูลค่าเพิ่ม และค่าเดินทางแล้ว) ทั้งนี้ ขั้นตอนการชำระเงินจะเป็นไปตามระเบียบของมูลนิธิโคเออร์

7. การทำสัญญา

ผู้ชนะการประมูล จะต้องทำสัญญากับมูลนิธิโคเออร์ ภายใน 7 วัน นับถัดจากวันที่ได้รับแจ้ง ในสัญญาจะระบุระยะเวลาการดำเนินงาน ค่าใช้จ่าย เงื่อนไขที่เกี่ยวข้อง และ TOR ฉบับนี้จะถูกแนบเป็นส่วนหนึ่งของสัญญา

8.กาารติดตามและการกำกับดูแล

การติดตามผลการดำเนินงาน จะทำโดยทีมประสานงานที่มูลนิธิโคเออร์ แต่งตั้งสำหรับโครงการนี้ ผู้รับจ้างจะต้องสื่อสารอย่างใกล้ชิดกับทีมประสานงาน เพื่อให้สามารถติดตามและตรวจสอบผลงานฉบับร่างทั้งหมดได้ ก่อนที่จะเข้าสู่ขั้นตอนการผลิตในลำดับถัดไป

9.หลักการด้านจริยธรรมและพฤติกรรมทางวิชาชีพ

เพื่อให้การดำเนินงาน เป็นไปตามหลักจริยธรรม ความโปร่งใส และมาตรฐานวิชาชีพที่เหมาะสม ผู้รับจ้างจะต้องยึดถือหลักการพื้นฐานดังต่อไปนี้

• การไม่เปิดเผยตัวตนและการรักษาความลับ : ผู้รับจ้าง ต้องเคารพสิทธิของผู้ให้ข้อมูล โดยไม่เปิดเผยตัวตน และต้องรักษาความลับของข้อมูลที่ได้รับอย่างเคร่งครัด ทั้งนี้ ข้อมูลที่ได้รับจะต้องถูกนำไปใช้เพื่อวัตถุประสงค์ของการดำเนินงานภายใต้โครงการเท่านั้น
• จริยธรรม : ผู้รับจ้างต้องลงนามใน จรรยาบรรณในการปฏิบัติงาน (Code of Conduct) และปฏิบัติตามอย่างเคร่งครัดตลอดระยะเวลาการปฏิบัติงาน เพื่อให้มั่นใจว่าการดำเนินงานเป็นไปตามหลักจริยธรรมและมาตรฐานทางวิชาชีพ
• ความเป็นอิสระ : ผู้รับจ้าง ต้องปฏิบัติงานอย่างเป็นอิสระจากโครงการหรือกิจกรรมที่อยู่ภายใต้การประเมิน โดยต้องไม่มีความเกี่ยวข้องหรือผลประโยชน์ร่วมกับฝ่ายบริหารหรือองค์ประกอบใด ๆ ของโครงการดังกล่าว
• การคุ้มครองข้อมูลส่วนบุคคล : ผู้รับจ้างตกลงที่จะรักษาความลับทางวิชาชีพและข้อมูลส่วนบุคคลใด ๆ ที่ได้รับจากการปฏิบัติงานอย่างเคร่งครัด และจะปฏิบัติตามข้อกำหนดเกี่ยวกับการคุ้มครองข้อมูลส่วนบุคคลตามที่ระบุไว้ในพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 อย่างครบถ้วน ข้อกำหนดดังกล่าวมีผลบังคับใช้ตลอดระยะเวลาของสัญญาการให้บริการ และยังคงมีผลต่อไปภายหลังการสิ้นสุดของสัญญาไม่ว่าด้วยเหตุผลใดก็ตามผู้รับจ้าง จะต้องดำเนินมาตรการด้านเทคนิคและมาตรการด้านการบริหารจัดการที่เหมาะสม เพื่อปกป้องความปลอดภัยของข้อมูลส่วนบุคคลที่สามารถเข้าถึงได้ และเพื่อป้องกันการเปลี่ยนแปลงการสูญหาย การประมวลผลโดยไม่ได้รับอนุญาต หรือการเข้าถึงข้อมูลโดยมิชอบ โดยคำนึงถึงเทคโนโลยีที่มีอยู่ ลักษณะของข้อมูลที่จัดเก็บ และความเสี่ยงที่อาจเกิดขึ้นจากปัจจัยด้านมนุษย์หรือสภาพแวดล้อม ทั้งนี้ต้องเป็นไปตามข้อกำหนดของกฎหมายคุ้มครองข้อมูลส่วนบุคคลที่เกี่ยวข้อง
• เหตุการณ์หรือปัญหาที่เกิดขึ้นระหว่างการดำเนินงาน : ปัญหาใด ๆ ที่เกิดขึ้นระหว่างการปฏิบัติงานภาคสนามหรือในขั้นตอนอื่นของกระบวนการดำเนินงาน จะต้องรายงานให้มูลนิธิโคเออร์ ทราบโดยทันที โดยที่มูลนิธิโคเออร์มีสิทธิส่งต่อข้อมูลดังกล่าวไปยังหน่วยงานผู้ให้ทุนตามความเหมาะสม ทั้งนี้ ปัญหาที่เกิดขึ้นไม่อาจใช้เป็นเหตุผลเพื่ออธิบายความล้มเหลวในการบรรลุผลลัพธ์ตามที่กำหนดไว้ใน TOR ฉบับนี้
• ลิขสิทธิ์ และการเผยแพร่ : ผู้รับจ้างต้องโอนสิทธิ์ ในการใช้และการเผยแพร่ผลงานที่จัดทำขึ้นภายใต้สัญญานี้ให้แก่มูลนิธิโคเออร์ ทั้งนี้ ตามสัญญาการให้ทุนระหว่างมูลนิธิโคเออร์และสหภาพยุโรปสหภาพยุโรปมีสิทธิ์ ในการใช้และเผยแพร่สื่อโสตทัศนูปกรณ์หรือผลงานใด ๆ ที่จัดทำขึ้นภายใต้โครงการ
• มาตรการลงโทษ : ในกรณีที่มีความล่าช้าในการส่งมอบรายงาน หรือรายงานที่ส่งมอบมีคุณภาพต่ำกว่ามาตรฐานที่ได้ตกลงไว้กับมูลนิธิโคเออร์อย่างชัดเจน ให้ใช้มาตรการลงโทษและกระบวนการอนุญาโตตุลาการตามเงื่อนไขและข้อกำหนดที่ระบุไว้ในสัญญาระหว่างมูลนิธิโคเออร์กับผู้รับจ้าง

10. ข้อกำหนดสำหรับการยื่นข้อเสนอ

ข้อเสนอที่ส่งมาจะต้องมีข้อมูลอย่างน้อยดังต่อไปนี้

• ข้อเสนอทางเทคนิค (Technical proposal)
• ข้อเสนอด้านงบประมาณอย่างละเอียด โดยต้อง รวมภาษีมูลค่าเพิ่ม (VAT) และ/หรือภาษีอื่น ๆ ที่เกี่ยวข้อง
• ประวัติย่อ (CV) ของผู้เสนอราคา และคณะทำงาน

11. เกณฑ์การคัดเลือกและประเมินผล

การคัดเลือกจะพิจารณาทั้ง ด้านเทคนิคและด้านการเงิน โดยเลือกข้อเสนอที่ สอดคล้องกับความต้องการขององค์กรและกิจกรรมที่เสนอมากที่สุด ข้อเสนอที่ส่งเข้ามาจะได้รับการประเมิน รวมทั้งหมด 100 คะแนนแบ่งดังนี้:

• คุณภาพทางเทคนิคของข้อเสนอและความเหมาะสมต่อวัตถุประสงค์ที่กาหนด: 40 คะแนน
• องค์ประกอบของทีมงาน: 40 คะแนน
• ข้อเสนอด้านการเงิน: 20 คะแนน

ผู้เสนอราคาจะได้รับแจ้ง ผลการคัดเลือกหรือไม่ผ่านการคัดเลือกภายใน 15 วัน นับจากวันที่เปิดข้อเสนอ

12. การยื่นข้อเสนอ

ข้อเสนอทั้ง ด้านเทคนิคและด้านการเงิน จะต้องส่ง ภายในวันที่ 4 พฤษภาคม 2569
